Kakome sale, at court

The many-years old conflict for the Kakome lands between the Nivice residents and the state authorities has arrived at the Court of Tirana.
The head of the Lukove Commune, Vladimir Kumi, asked the court to order a task force unit to investigate how the 29 hectares of the Kakome Bay were sold a few days after the Prosecution suspended the case.
Kumi claims to represent the residents' interest over the Lukove commune territory.
"I was informed that on March 2012, the Saranda Property Registration Office registered an application of an agreement for passing the properties from ALUIZNI (Agency of Legalization Urbanization and Integration of Informal Zone/Buildings), represented by the then general director, Shaban Memia, and bought by the Kakome Riviera ltd, represented by Jeko Kolev.
The head of the commune underlined that the agreement infringes all legalization laws, since ALUIZNI cannot legalize and sell this considerable surface of land at the same time. In fact, the head of the Lukove commune adressed to the Tirana Prosecution with a penal report, claiming that he suspects that there are abusive officials. But 11 days after this report, the prosecution decided to not start the case, since documents indicated that the sale of the 29.7 hectares of land referred to an agreement of 2004 between the Albanian state and the company in question, which provided the construction of a real estate tourist structure.
Referring to the project in question, the Prosecution says that the protected area is 70 hectares, with 32.2 ha of construction land. The prosecution says that the constructions have been suspended after the incidents with the Nivice residents. After this decision, the Nivice residents will sue the prosecution in a civil court.

Shitja e Kakomesë, në Gjykatë
Konflikti disa vjeçar për tokat e Kakomesë mes banorëve të Nivicës dhe autoriteteve shtetërore mbërrin në Gjykaten e Tiranës.
Nepermjet nje padie civile kryetari i komunes Lukove, Vladimir Kumi i kerkon gjykates te urdheroje njesine task-force te hetoje, se si u shiten mese 29 hektare toke ne Gjirin e Kakomese, pak dite pasi prokuroria pushoi procedimin penal per kete çeshtje.
Ne kerkesen e tij kryekomunari Kumi deklaron se perfaqeson ne kete padi interesat e banoreve ne lidhje me territorin ku shtrihet komuna e Lukoves.
"Une, - thote kryetari i komunes, - para disa kohesh mora informacion se ne mars te ketij viti ne Zyren e Regjistrimit te pronave Sarande eshte aplikuar per regjistrim te nje kontrate per kalimin e te drejtes se pronesise, nga Agjensia e Legalizim Urbanizimit dhe Integrimit te Zonave te Ndertimeve Informale, perfaqesuar nga drejtori i Përgjithshëm ne ate kohe Shaban Memia dhe bleres 'Riviera Kakome sh.p.k', perfaqesuar nga shtetasi Jeko Kolev".
Kryetari i komunes vijon pretendimin e tij, duke theksuar se kjo kontrate eshte ne shkelje te plote te ligjeve mbi legalizimet, pasi sipas tij ALUIZNI, nuk mund te legalizoje e njekohesisht te shese kete siperfaqe te konisderueshme toke. Ne fakt ne fillim te muajit maj te ketij viti kryetari i komunes Lukove i ishte drejtuar edhe Prokurorise se Tiranes me nje kallëzim penal, ku shprehet se ka dyshime qe zyrtaret kane shperdoruar detyren. Por 11 dite pas ketij kallëzimi prokuroria vendosi te mos e nise procedimin penal pasi referuar dokumentave sipas prokurorise shitja e truallit prej 29, 7 hektare me çmim 1521 leke metri katror eshte kryer referuar edhe nje marreveshje te vitit 2004 midis shtetit shqiptar dhe shoqerise ne fjale, ne te cilen parashikohej ndertimi dhe venia ne pune e nje strukture turistike ne pronen e paluajtshme.
Madje duke ju referuar projektit ne fjale prokuroria thote se sipas studimit urbanistik siperfaqja e zones se mbrojtur eshte 70 hektare, me siperfaqe totale te sheshit te ndertimit 32,3 hektare toke. Gjithashtu thote prokuroria eshte fakt i njohur boterisht se punimet ne zonen e Kakomese, Sarande jane pezulluar here pas here per shkak te incidenteve qe kane ndodhur me grupe banoresh te fshatit Nivice. Pas ketij vendimi te prokurorise tashme banoret e Nivices te perfaqesuar nga kryekomunari i tyre do te jene balle per balle ne procesin civil, ku pale e paditur eshte prokuroria . (Less)
