Basham: EPA Decision a Major Victory to Keep Community Clean The ongoing efforts of Senator Ray Basham (D-Taylor) on behalf of Romulus and the entire Downriver (More) The ongoing efforts of Senator Ray Basham (D-Taylor) on behalf of Romulus and the entire Downriver community have reached a major milestone in the fight against environmental pollution. The U.S. Environmental Protection Agency (EPA) Region 5 announced yesterday that they will be terminating all federal permits issued to Environmental Disposal Systems (EDS).
The EPA permits had allowed the Birmingham company to inject hazardous waste into two underground disposal wells—wells that were discovered to be leaking—at a facility in Romulus. Shutting down this company and putting an end to their bad environmental practices has been a top priority for Sen. Basham since he first entered the Michigan Legislature.
"Persistence does pay off, as the combined efforts of local residents, the environmental and business communities, and elected officials prevailed and put a stop to this pollution," Sen. Basham said. "This lengthy process is almost complete, and soon we can move forward with permanently closing this facility."
Since 2006, EDS had been accepting a variety of liquid hazardous wastes from industry and injecting them into a layer of rock nearly a mile underground. EPA's decision to terminate their federal permits is based on numerous violations, including failing to notify the agency of an ownership transfer, at the now-closed facility. Basham is charging that the MDEQ should now revoke EDS's state operating license and Part 111 permit.
"When the EPA issues a permit, it expects the permit holder to comply with all terms and conditions and EDS has not done so," said Kevin Pierard, Region 5's acting water division director. "Any potential new operator must start the permitting and public comment process from the beginning."
EPA originally approved permits to allow the injection of hazardous waste into the two disposal wells in 1998 and renewed the permits in 2004. Michigan Department of Environmental Quality inspectors found a leak in the surface piping of one of the wells during an October 2006 visit and ordered the facility shut down. Subsequent inspections by EPA confirmed the leak and identified numerous other violations of the permit conditions.
